By accessing or using TruckinBuddy ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. TruckinBuddy is operated by TruckinBuddy LLC, a Texas limited liability company ("Company," "we," "us," or "our"). These Terms apply to all users, including free and paid subscribers.
TruckinBuddy is a cloud-based fleet management software platform that allows trucking companies and owner-operators to manage trucks, trailers, drivers, loads, compliance, fuel, maintenance, and financial reporting. The Service is provided on a subscription basis with free and paid tiers.
To use the Service, you must create an account and provide accurate, complete information. You are responsible for:

TruckinBuddy offers free and paid subscription plans. By selecting a paid plan, you agree to pay the applicable fees. All fees are billed in advance on a monthly or annual basis and are non-refundable except as required by law.

You retain full ownership of all data you enter into the Service, including driver information, load records, financial data, and compliance documents ("Your Data"). By using the Service, you grant TruckinBuddy a limited license to store, process, and display Your Data solely to provide the Service to you. We will not sell Your Data to third parties. We implement reasonable technical and organizational measures to protect your data. However, no method of transmission over the internet or electronic storage is 100% secure. We cannot guarantee absolute security and are not responsible for unauthorized access resulting from your failure to maintain the security of your account credentials.
The Service, including its design, features, code, and content, is owned by TruckinBuddy LLC and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our express written permission. Your feedback and suggestions may be used by us without obligation to you.
The Service integrates with third-party services including Stripe (payments), Supabase (database and authentication), and Resend (email). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of any third-party service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. TRUCKINBUDDY IS NOT A LICENSED ACCOUNTANT, ATTORNEY, OR COMPLIANCE ADVISOR. NOTHING IN THE SERVICE CONSTITUTES LEGAL, TAX, OR REGULATORY ADVICE. YOU ARE SOLELY RESPONSIBLE FOR ENSURING YOUR OPERATIONS COMPLY WITH APPLICABLE LAWS INCLUDING FMCSA REGULATIONS AND IFTA REQUIREMENTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUCKINBUDDY LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless TruckinBuddy LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.
We may suspend or terminate your account at any time for violation of these Terms, non-payment, or any other reason at our sole discretion, with or without notice. Upon termination, your right to use the Service ceases immediately. You may request an export of Your Data within 30 days of termination. After that period, we may delete Your Data.
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in Texas. You waive any objection to jurisdiction or venue in such courts.
We may update these Terms at any time. We will notify you of material changes by email or by displaying a notice in the Service. Your continued use of the Service after changes become effective constitutes your acceptance of the updated Terms.
